Admission to the Legal Profession and to practise it under the Professional Title corresponding to the Profession in Malta
This application provides for foreign lawyers to request the warrant to practise as advocate or a legal procurator.
Appeal in the Administrative Review Tribunal
This application is used to submit a request before the Administrative Review Tribunal to review the administrative act of the public administration on matters of law and fact in terms of Article 15(2) of Cap. 490 of the Laws of Malta, the Administrative Justice Act. This application must contain a clear and correct statement of the matter and the reason for the request, the request or requests, clear exposure and detailed facts of the case as known by the applicant, the name of the witnesses the applicant intends to sue, including the summoning of the counterparty, with a declaration in respect of any witness evidence that the applicant intends to use and the remedy being sought, with the expenses against the public administration. All the documents supporting the request or requests can be attached to the application.
Application for Registration to Practise the Legal Profession in Malta under the Home-Country Professional Title and under the Professional Title corresponding to the Profession in Malta
EU (Non-Maltese) Legal Professionals wishing to practice their legal profession in Malta will be required to register with the local competent authority. Such registration will entitle them to practise under their home country professional title. Should such professionals wish to gain admission to the legal profession in Malta they would have to apply for a local warrant.
Application for Testamentary Searches
"Public Wills A testamentary search may be ordered on any person (living or deceased) to find out whether that person registered a public will. The search will not reveal the contents of the will itself but simply a summary stating the date of the will and the Notary who published the same will. The contents of the will can only be seen by the person drawing up the will or by his/her heirs. Secret Wills This application may also be used to search for secret wills of deceased persons. Such wills are deposited in the Civil Court (Voluntary Jurisdiction Section). Applicant will be informed of the result of the search and if it is positive, an application may be filed in the Registry of the court by an advocate or notary for the publication of the secret will."
Counter-Claim (Form 6)
This form is to be submitted by the Respondent and is used in voluntary arbitration proceedings. This form must be accompanied by a filing fee.
Counter-Claim (Form 6A)
This form is to be submitted by the respondent and is used in mandatory arbitration proceedings. This form must be accompanied by the filing fee and arbitrator's fee.
Court of Magistrates Affidavit
An affidavit must be confirmed on oath in the presence of the Deputy Registrar or Commissioner of Oaths.
Criminal Courts (Malta) Juror Exemption
With this application, one may request the Court to be exempt from serving as a juror. According to Article 607(1) of the Criminal Code this application must be filed within four days after writ of service. If the request to be exempt is for example based on a medical condition, the original copy is necessary. A scanned copy is not accepted by the Court, thus electronic submissions are not sufficient. In the case where according to Article 604 of the Criminal Code, one is included in the list exempted from serving as juror, a letter addressed to the Registrar is enough to be deemed as an application.
File a Claim in the Courts of Magistrates
This application is used to file a claim in the Courts of Magistrates. The following type of applications may be filed through this eForm: • Notice – Monetary claim • Notice – Point of law • Revocation of warrant application • Slander and libel application • Application contesting Judicial Letter issued in terms of Art. 166A of Cap.12 • Application in terms of Art. 466 of Cap. 12 • Application contesting judicial costs Applications filed online shall, for all intents and purposes of law, be deemed as if they have been filed directly in the Registry of the same Court; provided that when an application is filed online outside registry opening hours as established by the Code of Organization and Civil Procedure, such act shall be deemed to have been filed on the first following day of the opening of the said Registry.
Judicial Letter
Any judicial letter, excluding those that require an oath, may be presented online through this eForm. Additionally documents that substantiate the claim can be attached.
Application to Order Deeds or Wills
Clients may request copies of public deeds or wills from the Notarial Archives. With the use of such eForm, clients may now be immediately directed to the link of the Office of the Notary to Government and order a copy of a notarial deed or public will online, rather than physically calling at this Office or communicating by phone with Notarial Archives personnel. Clients will be ascertained that their online application will be processed vis sms or email where applicable. Upon application, an sms and an email (where applicable) will be sent to clients notifying them via sms or email that the copy ordered is ready together with the exact fees due.
Request for Exemption or Reduction of Fees in Connection with Research
This form is used by the this Office to exempt a researcher from paying the fees charged for inspecting notarial acts and to benefit from reduced rates on copying services carried out by the Department.
Termination of Mandates of a General Nature between Physical Persons
A power of attorney may simply be revoked by filling in the attached form and presenting it to the Office of the Notary to Government. There is no need to notify all the commercial banks and Notaries in Malta in Gozo since application will be uploaded online on the same day when presented. Each application presented will cost €50.
