Article 5 - Any fractionation of rural real estate must be carried out in such a way that the independent properties that resulted allow the use of land and water in accordance with the basic technical standards referred to in numeral 5) of article 3 of this law.
If, as a consequence of the fractionation, one or more smaller estates of 50 Hectares result, the survey engineer in charge of lifting the plan must request, previously, as a requisite for registration, a technical-agronomic foundation to the Regional Agricultural Office, which will have a term of thirty business days to be issued. After the expiration of the term without the Regional Agricultural Office, the acting surveyor engineer may register the fractionation plan in the General Directorate of the National Cadastre, without any other procedure. |
